1. The Contract Between You & Us

We must receive payment in whole for the price of the items that you order before your order can be accepted.

Once payment has been received by us we will confirm that your order has been received by sending an email to you at the email address you indicate when you order. Please note that this does not mean that your order has been accepted.

Our order acceptance is valid from the date of acceptance of payment from you unless we notify you that we do not accept your order, or you have cancelled your order in accordance with our refund policy.

Our order acceptance begins a legally binding contract between us. Only adults (persons aged 18 and over) are entitled to enter into legally binding contracts and as a result are the only people entitled to transact through this site. Any other individuals who are unable to perform legally binding contracts are prohibited from ordering goods using this site. If you do not qualify do not use this site.

A person who is not party to these terms and conditions or a Contract shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.

2. Pricing & Payment

The prices payable for items that you order are as set out in our website in GBP (UK Pounds) and are inclusive of VAT. You will be invoiced in GBP (UK Pounds) but if you purchase from outside the country, currency fluctuations and credit card charges may change the amount invoiced on your credit card.

We make every effort to ensure that prices on the website are correct at the time of publication and we reserve the right to amend these without prior notification. In the unfortunate event that we have incorrectly priced an item, we will contact you to make suitable arrangements and either confirm or cancel your order as necessary. However, if the pricing error is obvious and unmistakable and could have reasonably been recognised by the average customer as an error, we do not have to provide the item to you at incorrect (lower) prices even where we have confirmed the order.

All items listed on the website can be affected by the movement in the price of precious metals and diamonds and are therefore subject to change as necessary. We monitor the pricing on our website on a regular basis and aim to update our site as often as possible.

3. Availability

Our shops carry a selection of items but we cannot guarantee the availability of all items advertised on our website in-store. Our sales team can arrange for the transfer of items between our Guildford and Cranleigh, Smithbrook Kilns stores, should you require. Please contact us for further information about this service.

4. Right To Cancel

5. Cancellation By Us

We reserve the right to cancel the contract between you and us if:

  • We have insufficient stock to deliver the items you have ordered;

  • We do not deliver to your area;

  • We suspect the payment to be fraudulent and / or we have not received full payment for the item(s);

  • We believe that the item(s) have been priced incorrectly, see 'Pricing and payment', above, for details.

If we do cancel your contract we will notify you by email or by telephone and refund you according to our policy here. We will not be obliged to offer any additional compensation for disappointment suffered.

6. Delivery

We will deliver the item(s) ordered by you to the address you give us for delivery at the time you make your order. It is your responsibility to ensure that the delivery address you give us is correct and accurate and that there is somebody to sign for and take delivery of the item(s) from the delivery service used.

Once the order has been dispatched to you, you do become the owner of the items and they are held at your own risk. We are not liable for their loss or destruction.

If your order is returned to us because the courier or postal service could not complete the delivery to you for whatever reason, then you will be responsible for the repeat delivery costs.

7. Liability

If the items we deliver are not what you ordered or are damaged or defective or the delivery is of an insufficient quantity, we shall have no liability to you unless you notify us by email of the problem within 30 days of the delivery of the goods in question.

If you do not receive items ordered by you within 14 working days of the date on which you ordered them, we shall have no liability to you unless you notify us by email or telephone at our contact address of the problem within 14 days of the date on which you ordered the items. If you notify us of a problem under this condition, our only obligation will be, at your option either:

  • to make good any shortage or non-delivery; or

  • to replace any items that are damaged or defective; or

  • to refund to you the amount paid by you for the items in question in whatever way we choose.

Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify us of under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the items.

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase items from our site. The importation or exportation of certain of our items to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the items you purchase.

Your statutory rights are not affected.

We cannot be held responsible for any delays once the goods have left us and are in possession of the courier or Royal Mail.

8. Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

9. Privacy

You acknowledge and agree to be bound by the terms of our Privacy Policy.

10. UK Law

Each and every transaction carried out is deemed to be completed within the United Kingdom and therefore shall be governed by and interpreted in accordance with English Law. The terms of this charter (and any dispute, controversy, proceedings or claims of whatever nature in relation to them) shall be governed and interpreted in accordance with English Law and the English Courts shall have exclusive jurisdiction in relation thereto.

11. Trade Marks

All trademarks, product names and company names or logos sited herein are the property of their respective owners. No permission is given by us in respect of the use of any such brand names, photographs, product names or titles or copyrights and such use may constitute an infringement of the owners’ rights.

12. External Forces

We will not be in breach of this Agreement or otherwise liable for any delay in performance if to the extent that any delay or failure is due to circumstances beyond its reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion, accident, epidemic or pandemic.

13. Our Rights

We reserve the right to change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.

14. Official Dispute Resolution

We are proud to be a member of the National Association of Jewellers (NAJ) and are part of their 'Resolve' dispute resolution service. In the unlikely event that all efforts by us to settle a complaint or dispute have been unsuccessful, you can register a dispute with the NAJ by completing the online complaint form. If you do not have access to the internet you can request a call back from the NAJ compliance officer by calling 0121 237 1111. You will receive notification that they have received your complaint within five working days.

15. Entire Agreement

These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the items to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any items offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading. This agreement supersedes all previous discussions, correspondence, understandings and agreements between us relating to the Contract discussed above.

We make no representations or warranties about the accuracy completeness or suitability for any purpose of the information and related graphics published on our website. From time to time our site may contain technical inaccuracies or typographical errors.
